Terms and Conditions

The website www.mychatelles.com (here after the “Site”) is edited and managed by the company POLYVALENCE SAS (here after “Polyvalence” or the “Company”), its headquarters are at 92 rue de Varenne, 75007 Paris, France and it is registered at the “Registre du commerce et des sociétés de Paris” under the number 751 529 009, with the European VAT code number FR34751529009.

2. PURPOSE

This retail website can be accessed on the internet at the address www.mychatelles.com (hereinafter the "Site") and is open to any user of such a network (hereinafter the "Buyer").

These General Terms and Conditions of Sale (hereinafter “GTCS”) are concluded between Polyvalence SAS and every non-professional person who wishes to carry out a purchase on the website (hereinafter “the Buyer”).

The Site is published and managed by the company Polyvalence SAS, RCS Paris 751 529 009, headquartered at 92 rue de Varenne, 75007 Paris.

All orders placed on the Site presuppose prior consultation and full and unreserved acceptance of these General Terms and Conditions of Sale ("GTCS"), which can be consulted on the Site. The GTCS govern relations between the Site and any Buyer making a purchase via the Site.

Polyvalence SAS may amend the GTCS without notice at any time.

The GTCS may in no event be amended by the Buyer. The GTCS in force shall be those published on the Site at the time when the Buyer places their order on the Site.

If a Condition of Sale was found to be lacking, it would be considered as being governed by the provisions in force in the remote sales/in-home shopping sector whose companies are headquartered in France.

Should one or more provisions in these GTCS be rendered invalid subsequent to the application of a French legal provision or court ruling, the other provisions shall remain in force.

3. ORDERS

a. Buyers

The Buyer hereby declares that he/she has read and accepted these GTCS in their entirety prior to placing his/her order on the Site.

To be entitled to place a valid order on the Site, the Buyer must be at least 18 years of age and have legal capacity or be in possession of parental authorisation permitting him/her to place orders on the Site.

The Buyer therefore declares having the capacity to enter into this Agreement and not be under guardianship.

The Site reserves the right to ask any Buyer to provide proof of his/her age or of his/her parental authorisation, and not to honour the Buyer's order should the latter fail to provide such proof.  

The Site reserves the right to cancel any order (against refund) deemed not to meet the aforementioned criteria, without it however, being liable.

When the Buyer gives Polyvalence SAS, via the Site, their bank account details, needed for delivery of the product(s) featured on the site they must check the accuracy and the exhaustiveness of this information. In the case of a mistake in the contact details, Polyvalence SAS could not be held responsible for the inability to deliver products.

b. Products

The products sold by Polyvalence SAS are those shown on the Site on the day the Buyer consults the Site.

The Site may in no event be held liable if the illustrations are incorrect. Furthermore, the Site may not be held liable if the descriptions of the products shown on the Site do not match those delivered insofar as any errors do not affect the essential characteristics of the product, within the meaning of Article L111-1 of the French Consumer Code.

The Site shall inform the Buyer of the latest date by which it undertakes to deliver the products selected by the Buyer.

The Site shall honour orders placed by the Buyer as long as stocks last. Polyvalence SAS shall do its utmost to present an up-to-date record of product availability on the Site.

In the event that, in spite of the vigilance of Polyvalence SAS, one or more product(s) ordered by a Buyer are temporarily or permanently unavailable, or if the delivery time should exceed the date indicated on order by more than seven (7) days (except in cases of extreme and extenuating circumstances), Polyvalence SAS shall inform the Buyer thereof by email.

The Buyer shall then have the option of modifying or cancelling his/her order by mailing Polyvalence SAS by mail at contact@mychatelles.com.

Should an order be cancelled owing to delayed delivery, the Buyer shall be required to express his/her wish to cancel or modify his/her order within hundred (100) calendar days at the latest according to the date given for delivery of the order.

In the scenarios given in this paragraph, Polyvalence SAS undertakes to reimburse the Buyer whose payment has already been debited at the earliest opportunity and within twenty-five (25) days after payment at the latest. Polyvalence SAS shall not pay any compensation to the Buyer in such cases where endeavours are not achieved.

c. Prices

The prices of the products shown on the Site are in euros, including VAT for orders in France and import fees for orders abroad (net of French VAT).

Discounts shall be applied on order and shown in the Buyer's shopping basket, if he/she meets the terms and conditions that apply to take advantage of them and has correctly filled in the promotion codes.

The Buyer's contribution to shipping costs amounts, depending on the terms of delivery is as follows:

- Free shipping costs with national postal services, with online tracking and delivery against signature for all shipments in the EU (metropolitan France, Corsica and Monaco), except Switzerland, the UK and the DOM TOM. There is also the option of express shipment by DHL for €13.90 for France and €19.90 for the EU (or equivalent oin other currencies) per pair (the price increases proportionately for each additional pair).

- DHL Express Worldwide - Rest of the world (incl. USA, Asia and any other countries): €29.90 per pair (or equivalent in other currencies). The price increases proportionately for each additional pair. Free shipment for orders from 300€.

The aforementioned shipping costs decrease in price if several pairs are placed in the same order, and will be indicated in the summary of any order of a product(s) on the website. 

CAUTION: If the delivery country is not part of the European Union, customs duties may be charged to the recipient. Polyvalence SAS has no control over these charges that are the sole responsibility of the Buyer and must be incurred by the Buyer.

Polyvalence SAS reserves the right to change the prices without notice at any time. The prices applicable to the Buyer on order shall be those shown on the Site at the time of the Buyer's confirmation of his/her order on the Site.

d. Payment

The Chatelles (Polyvalence SAS) website uses the Stripe secure payment system. The entire transaction is sent in encrypted mode to a bank validation server in SSL (Secure Socket Layer) mode.

No bank information is stored on our server and Polyvalence SAS has no access to Buyers bank details: the input form is hosted directly at our partner bank, BNP. We thus guarantee you a high level of security for all of your transactions on the Site.

Should the Buyer pay for his/her order with a non-French debit/credit card, such debit/credit card must be valid for international transactions. Furthermore, any commissions or other costs regarding payment that may be charged to him/her by his/her bank or by BNP, which is provided to Chatelles’ (Polyvalence SAS) Stripe secure payment system, shall be charged to the Buyer.

The sum to be paid for the order is indicated to the Buyer on the internet page summarising the items in his/her order. Before proceeding with payment, the Buyer therefore has the opportunity to check the details of his/her order and the total price online and correct any errors.

Payment is payable on order, by debit/credit card (including Amex) and Paypal only. The Buyer guarantees Polyvalence SAS that he/she is fully entitled to use the debit/credit card used to pay. Should a Buyer's payment be refused by the bank, Polyvalence SAS reserves the right to cancel shipping of his/her order. All new orders placed by such Buyer may be suspended or cancelled by Polyvalence SAS.

Only the debit/credit cards mentioned on the website are accepted. When placing the order, the Buyer must provide the Site with the relevant information on his/her debit/credit card requested of him/her (card number, expiry date, security code (on the back of the card)). The online payment is secure. The information processed is encrypted, and only the online payment system can access them.

The Buyer's debit/credit card shall be debited on confirmation by our bank of acceptance of the Buyer's payment.

The products continue to be the full and entire property of Polyvalence SAS until payment for the products invoiced has been collected in full, including shipping costs and taxes.

Payment is the final stage in confirmation of the order. The Buyer may modify any of the items in his/her order at any time, until he/she has confirmed payment. When payment is confirmed by the Buyer, the order is validated and becomes firm.

The Buyer shall receive an email from the Site at the email address provided, acknowledging receipt and summarising the items in the order that he/she has placed.

The Buyer expressly recognizes that the transmission - in addition to the full name as it appears on their credit card - their card number, the expiration date of the latter and, above all, its cryptogram give authorisation to debit their account of the price of the Product(s) ordered on the Site. 

e. Delivery

Upon confirmation by the bank of acceptance of the Buyer's payment, Polyvalence SAS shall process the order insofar as stocks last.

Orders are delivered to the delivery address provided by the Buyer when ordering on the Site, provided that contact details are correct.

As Polyvalence SAS has no control over such times, the payment of any penalties or compensation to the Buyer by Polyvalence SAS shall not be accepted on any grounds. Conversely, the Buyer is entitled to cancel his/her order according to the terms laid down in Article 3–b of these GTCS.

If, in spite of everything, it proves impossible to complete delivery or should the Buyer refuse to accept said delivery, the parcel shall be returned to Polyvalence SAS. The products ordered shall be reimbursed (by crediting the debit/credit card used during the order) within twenty-five (25) days at the latest of return of the parcel to Polyvalence SAS.

Delivery times are likely to vary depending on the destination chosen by the buyer, however it should not exceed ten (10) days beginning at 9am on the day after the purchase, Monday to Friday.

The following delivery times have been made available by the carriers (national posts of each countries) solely for information purposes:

• European Union: within 4 to 7 working days (count up to 3 more days for Austria)
• The rest of the world: within 7 to 10 days depending on the country
• Embroidered pairs will be delivered within 6 to 8 weeks. 

Delivery times provided here are those advised by DHL the carriers (national posts of each countries).

Delivery times are counted in working days, nonetheless exceptions do occur according to the country of delivery, notably in EU and in international countries outside of the EU.

The client can follow their parcel on the internet by using their order number and the link which was sent to them after placing their order.

Polyvalence SAS cannot be held responsible for the proper execution of the carriers' obligations. to the extent that the failure or improper performance of their obligations to the Purchaser, the result is attributable to the latter or an unpredictable and insurmountable third party to organise a distance selling contract with the latter or in the case of a major event (see Art. L.121-20-3 of the Code of Conduct).

Similarly, and more generally, if the direct responsibility of Polyvalence SAS was questioned, the Company may waive all or part of aforementioned responsibility by proving that the non-performance or improper performance of the contract concluded with the Buyer (with DHL) and is attributable either to it or to the fact of an unpredictable and insurmountable third party contract, or in the case of a major event.

Delivery of orders is guaranteed by  the carriers. Delivery times are likely to vary depending on the selected country’s location and the time of the order by the buyer.

-     Domestic shipments: national delivery within 7 days after the parcel was sent. Door-to-door delivery against signature, 24 hour parcel tracking service, available for all French destinations (mainland France, Corsica and Monaco).

-    EU and worldwide shipments: door-to-door delivery (signature required) between one (1) and ten (10) days after the order was sent depending on the destination.

A delay of 1 day in Europe, 2 days in Asia and the Middle East and anywhere else in the world. Delivery available worldwide. The carrier offers a secured network and parcel tracking 24 hours a day, 7 days a week. Customs clearance if necessary (except out of the EU) is operated by the carrier before the physical arrival of the goods.

The parcel will be traceable on the internet with the number and the link sent via email after every order.

If the parcel reaches the Buyer damaged or open, the Buyer must refuse to accept delivery by the deliveryman, pointing out the damage noted and filing a claim with him for the anomaly. All parcel deliveries accepted by the Buyer shall be deemed free of defects imputable to delivery.

A delivery slip confirming the details of the Buyer's order is enclosed in the parcel.

f. Returns and right of withdrawal

The buyer may return any products which he does not wish to keep within one hundred (100) calendar days as of the date of receipt of his order.

To obtain a refund on these products or the exchange them for another size or another product (within the limits of available stocks), the buyer must pay the return costs and must return the product(s) to us new and in their original packaging within one hundred (100) calendar days as of the date of receipt of his/her order. During sale periods and private sales the products are non-refundable. You can make an exchange or receive a credit valid for 1 year for future purchases. In the context of archive sales, sales are final, items are non-refundable and non-exchangeable. 

We would ask the buyer to package the products carefully in order to avoid any problems with the return.

In a case of an exchange in size, the shipping costs for the second parcel will be borne by Polyvalence SAS.

Prior to the return of the product by the buyer, the latter must email contact@mychatelles.com to apply for a return or an exchange.

Returned parcels must be sent to the following address only:

Centre Logistique Chatelles / ESAT, 112 Rue du Château, 76410 Cléon, France, +33 2 35 05 99 60.

It is recommended that the Buyer keeps proof of the dispatch of his/her parcel provided by the postal services. If the parcel is not received by Polyvalence SAS, and without proof of its correct distribution by the postal services, the liability of Polyvalence SAS may not be invoked. All risks related to the return of the product shall be borne by the Buyer.

If the parcel is returned to Polyvalence without being opened, the cost of return to Polyvalence shall be borne by the Company. (Unless otherwise agreed by Polyvalence SAS)

Furthermore, if the Buyer receives products from Polyvalence SAS which do not match his/her order, he/she shall be invited to contact Polyvalence SAS, within 30 (thirty) days of receipt of his/her order, by email: contact@mychatelles.com, in order that Polyvalence SAS can confirm such non-conformity and inform him/her of the return procedure at the expense of Polyvalence SAS.

Conversely, if the parcel is opened and the products match the order, the cost of return to Polyvalence SAS shall be borne by the Buyer.

Polyvalence SAS does not accept the return of products carried forward.

IMPORTANT : For non EU clients who wish to return/exchange a product, please mention on the parcel that the content does not have any commercial value, to avoid any customs duties that Polyvalence SAS would be charged. 

When sending back an exchanged product, Polyvalence SAS shall do the same to avoid a second customs duty charged to the buyer.

The Buyer shall be reimbursed by Polyvalence SAS for all sums paid on order for the products that he/she has returned, with the exception of the cost of return shipping to Polyvalence SAS, which shall be borne by the Buyer. If the Buyer returns his/her order in full, the initial shipping costs (shipment of the parcel to the Buyer by Polyvalence SAS) shall be refunded. If the Buyer returns only part of his/her order, the initial shipping costs (shipment of the parcel to the Buyer by Polyvalence SAS) shall not be refunded. Refunds on returned products shall be made by crediting the debit/credit card or Paypal account used on order within a period of twenty-five (25) days as of the date of receipt of the returned parcel by Polyvalence SAS.

All returns received by Polyvalence SAS that do not follow the procedure set out in this Article might not be refunded by Polyvalence SAS.

4. WARRANTY

All products sold by Polyvalence SAS are covered by a legal warranty of conformity as stipulated in articles L.211-4 to L.211-14 of the French Customer Code and by legal warranty of defects in the object of purchase as stipulated in articles 1641 to 1649 of the French Civil Code.

5. INTELLECTUAL PROPERTY

Polyvalence SAS owns the rights over this Site and all elements, trademarks, logos, illustrations, texts, sound effects, etc. appearing hereupon.

Polyvalence SAS does not consent to any licences or rights other than the right of access to and consultation of this Site.

Reproduction or use of all or part of the Site is permitted only for the purposes of strictly personal and private information. Any other use made without the prior authorization of Polyvalence SAS in writing shall constitute an act of computer piracy and may be sanctioned accordingly.

6. DATA PROTECTION

Data of a personal nature provided by the Buyer and collected by Polyvalence SAS when the Buyer places an order are obligatory and needed to process and manage his/her order. Should the Buyer fail to provide such information, Polyvalence SAS shall be unable to process the Buyer's order.

Pursuant to the French Data Protection Act No. 78-17 of the 6^th of January 1978 modified by Act No. 2004-801 of the 6^th of August 2004, the Buyer is entitled to access, rectify, oppose and cancel personal data concerning him/her held by Polyvalence SAS by writing to:

7. MISCELLANEOUS PROVISIONS

a. Computer or technical problems on the Site

Polyvalence SAS declines any responsibility in the event of interruption, poor functioning or fraudulent intrusion on the Site.

Polyvalence SAS may not be held liable in the event of loss of data or files resulting from consultation of the Site. It behoves the Buyer to make any safeguards necessary prior to placing his/her order on the Site.

b. In the case of extreme and extenuating circumstances

The liability of Polyvalence SAS may not be invoked for the total or partial failure to abide by the obligations in these GTCS in the event of the occurrence of an extreme or extenuating circumstance such as a natural disaster as defined by Article 1148 of the French Civil Code.

c. SHINEINFLATS code

Offer of 10% off upon subscribing the newsletter can not be cumulated with any sale or special offer.

8. LAW APPLICABLE AND JURISDICTION

Sales of Polyvalence SAS products are subject exclusively to French law, regardless of the country to which the products are delivered.

Failing amicable solutions, all litigation relating to the interpretation, fulfilment or breach of the contract concluded between Polyvalence SAS and the Buyer, even in the case of multiple defendants, shall fall under the exclusive jurisdiction of the courts of Paris (France).

The brand names and logos shown on this site are registered trademarks. No licences or rights of use may be assigned to any one of aforesaid brand names or logos shown on the site, which shall therefore not be used without the prior written consent of the owner.

The reproduction of any documents published on the site is permitted only for informative and exclusively private purposes. All and any other use of such reproductions, particularly use for commercial purposes, is expressly forbidden, unless otherwise first agreed in writing by Chatelles (Polyvalence SAS).

Chatelles (Polyvalence SAS) reserves the right to prosecute all and any acts of piracy of its intellectual property rights, including criminal prosecution.

LIABILITY
